These Terms of Use ("Terms") govern access to and use of the website located at nsadamson.com (the "Site"), operated by NS Adamson Development and Consulting LLC, a Texas limited liability company ("Company," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms.
This Site is provided for general informational purposes about the Company's software development and consulting services. Nothing on this Site constitutes a service agreement, professional engagement, or contractual offer. Any engagement for services is governed exclusively by a separate written agreement signed by both parties.
§2 No professional advice; no guaranteed results
Content on this Site is general in nature and does not constitute legal, financial, tax, or professional advice. Descriptions of past work, capabilities, or potential outcomes are illustrative only and do not guarantee any specific result for your project.
§3 Intellectual property
All content on this Site — including text, graphics, logos, and design — is the property of the Company or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without prior written permission.
§4 Submissions
Information submitted through the contact form is used as described in the Privacy Policy below. Do not submit confidential or proprietary information through the Site prior to a signed engagement agreement and, where appropriate, a mutual non-disclosure agreement.
§5 Third-party services
This Site is hosted and its contact form is processed using third-party infrastructure providers, currently Cloudflare, Inc. and Zoho Corporation. The Company is not responsible for the availability or performance of third-party infrastructure.
§6 Disclaimer of warranties
The Site is provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by Texas law.
§7 Limitation of liability
To the fullest extent permitted by law, the Company is not liable for indirect, incidental, special, or consequential damages arising from use of, or inability to use, the Site.
§8 Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Disputes arising from these Terms or the Site are subject to the exclusive jurisdiction of the state or federal courts located in Travis County, Texas.
§9 Changes to these terms
These Terms may be updated from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

§1 Notice regarding applicability
As a small business, the Company qualifies for the small-business exemption under the Texas Data Privacy and Security Act (Tex. Bus. & Com. Code ch. 541). The disclosures below are provided voluntarily, as a matter of transparency.
§2 Information we collect
When you submit the contact form, we collect the information you provide — typically your name, email address, company, and message. Our hosting provider (Cloudflare) may also automatically log standard technical information, such as IP address and browser type, for security and performance purposes. We do not knowingly collect or process sensitive personal information (such as racial or ethnic origin, health, or biometric data).
§3 How we use your information
We use submitted information solely to respond to your inquiry, communicate about your potential or active project, and where necessary to comply with our legal obligations. We do not use contact-form submissions for unsolicited marketing.
§4 No sale of personal data
We do not sell your personal data, and we do not sell sensitive personal data, to any third party. We have not disclosed, sold, or shared personal information with third parties for a business or commercial purpose in the preceding twelve months, and do not intend to.
§5 Third-party service providers
We use the following categories of third-party service providers to operate this Site: Cloudflare, Inc. (website hosting and content delivery) and Zoho Corporation (email delivery for contact-form submissions, via our existing business mailbox). These providers process data on our behalf and are not authorized to use it for their own independent purposes. If the Company is ever involved in a merger, acquisition, or sale of assets, personal information may be transferred as part of that transaction, subject to this Policy.
§6 Cookies and tracking
This Site does not currently use tracking or advertising cookies. If that changes — for example, by adding privacy-focused analytics — this Policy will be updated before the change takes effect.
§7 Do-Not-Track signals
Most browsers include a Do-Not-Track ("DNT") setting, but no uniform technical standard for recognizing DNT signals currently exists. We do not respond to DNT signals at this time. If a legal or industry standard is adopted, we will update this Policy accordingly.
§8 Data retention
Contact-form submissions are retained only as long as reasonably necessary to respond to your inquiry and maintain business records, after which they are deleted or archived securely.
§9 Your choices and rights
Regardless of exemption status, you may contact us at nathaniel@nsadamson.com at any time to ask what information we hold about you, request correction of inaccurate information, or request deletion of your information. We respond to verifiable requests within a reasonable time. If we decline a request, you may appeal by contacting us at the same address; if the appeal is denied, you may file a complaint with the Texas Attorney General.
§10 Children's privacy
This Site is not directed to children, and we do not knowingly collect personal information from anyone under 18. By using this Site, you represent that you are at least 18, or are a parent or guardian using the Site on behalf of a minor. If we learn we have collected information from someone under 18, we will take reasonable steps to delete it.
§11 Changes to this policy
This Privacy Policy may be updated from time to time. The "last updated" date above reflects the most recent revision.
